The LGA has developed a template permit for councils to issue under section 222 of the Local Government Act, for the operation of food trucks (mobile food vendors) when the legislation commences on 1 March 2018. The template permit has been drafted for the LGA by Tanom Legal.
In addition, following the promulgation of the Local Government (General) (Mobile Food Vendors) Variation Regulations 2017 last week, the LGA has updated the template Location Rules that were issued in circular 42.5 on 18 October 2017. The reason for the update is that the clause numbering in the Regulations changed when they were made and no longer accords with the clause numbering in the template Location Rules issued earlier.
As indicated in an earlier circular, officers from the Department of Premier and Cabinet also drafted guidelines for Location Rules. Tanom Legal has reviewed these Location Rules for the LGA and has advised that it may be more helpful to develop a template permit for councils rather than attempt to amalgamate the two sets of Rules. The LGA accepted the advice and the template permit is now available.
