Payment to the remuneration tribunal for setting council member allowances

The LGA is required by legislation to reimburse the Remuneration Tribunal for its reasonable costs in making a determination for setting Council Member Allowances.

Project approach

The Local Government Act 1999 and the City of Adelaide Act 1998 provide that a council member is entitled to receive an allowance determined by the South Australian Remuneration Tribunal and that the Tribunal must make those determinations on a four yearly basis prior to local government periodic elections.
Section 76(13) of the Local Government Act 1999 and section 24(13) of the City of Adelaide Act 1998 provide that the LGA must pay the reasonable costs of the Tribunal in making the determinations.
The Minister for Transport, Infrastructure and Local Government facilitated consultation between the Remuneration Tribunal and the LGA. It was agreed that the LGA would reimburse the costs upon conclusion of the review, receipt of an invoice and statement of costs.

Project achievements

On 30 August 2018, the Remuneration Tribunal released its reports and determinations on council member allowances. Separate reports and determinations were made for Adelaide City Council (under the City of Adelaide Act) and all other councils (under the Local Government Act).

Project distribution

The Remuneration Tribunal published the reports and determinations. The Remuneration Tribunal also published notices in The Advertiser, regional newspapers and The Messenger.
The LGA released LGA Circular 36.1, emailed the Governance and Policy Officer Network and included an article in the CEOs newsletter, to notify members of the release of the Remuneration Tribunal reports and determinations.

Performance measures

Reimbursement of the Remuneration Tribunal’s reasonable costs is a legislative obligation of the LGA. The Remuneration Tribunal invoiced the LGA for $56,289.86 (inc GST) on 16 October 2018. The LGA met its legislative obligations upon processing payment of this invoice within 14 days.

In 2014, the LGR&DS paid $57,649.00 for the full cost of the work by the Remuneration Tribunal. In 2010, the full cost of the work by the Remuneration Tribunal was $47,866.92. The LGA requested $70,000 in LGR&DS funding based on an expectation of a similar $10,000 increase from the previous review. The review came in under budget and the remaining $18,827.40 will be returned to the LGR&DS.

The LGA fulfilled its legislative obligation to reimburse the Remuneration Tribunal upon processing payment of the invoice provided to the LGA.
