The State Government is now consulting on proposed changes to the community and strata titles legislation in the:
- draft Statutes Amendment (Community and Strata Titles) Bill 2022
- draft Community Titles (Resolutions) Amendment Regulations 2022
Proposed changes in the draft Statutes Amendment (Community and Strata Titles) Bill 2022
The proposed changes in the Bill include:
- tightening regulation of body corporate managers, particularly in relation to conflict disclosure and the charging of fees making it easier to achieve a quorum at corporation meetings
- increasing the minimum mandatory public liability insurance from $10 million to $20 million
- increasing the threshold for when mandatory audits of corporation accounts are required by community corporations
- other changes described in the explanation of the draft Bill.
Proposed changes in the draft Community Titles (Resolutions) Amendment Regulations 2022
The proposed changes address concerns about the community corporations’ ability to quickly respond to:
- notices to replace flammable cladding
- other building rectification notices.
This is in light of the current need to get a unanimous resolution of owners to spend on works if they exceed the specified threshold per apartment.
