Register for an information session on Local Nuisance and Litter Control Act Reform
Councils are invited to provide feedback on the draft Local Nuisance and Litter Control Amendment Bill and Regulations.
The Local Nuisance and Litter Control Act 2016 (LNLC Act) came into effect (in its entirety) on 1 July 2017.
The LNLC Act expanded the role of local government in responding to nuisance issues in the community. The LNLC Act provides the community with an effective and consistent approach for the management of litter and nuisance complaints.
In July 2019, after councils had experienced two years of administering the legislation, the Environment Protection Authority (EPA), on behalf of the South Australian Government, commenced a review of the LNLC Act.
The LGA has ensured local government’s voice has been heard throughout the review process by providing formal written submissions to the EPA. This is through seeking feedback from members, holding meetings and information sessions for councils, and through the formation of a LNLC working group (consisting of council officers, the LGA and the EPA).
Proposed changes to the LNLC Act and Regulations
Through consultation with councils and the community, the EPA has proposed changes to the LNLC Act and Regulations. The main proposed changes are:
Draft Bill
- General amendments are proposed to streamline a number of existing provisions of the Act.
- Greater clarification on how abandoned trolleys can be managed using the Act.
- Differential expiations for a number of offences and new offence provisions
- General Duty for business owners to minimise litter.
- Further clarification the Act does not apply to nuisance associated with the service of alcohol.
Draft Variation Regulations
- Inclusion of light as an agent of local nuisance
- Further clarification on what is not local nuisance.
