Changes to advertising requirements for events on roads – s33 Road Traffic Act 1961
Section 33 of the Road Traffic Act 1961 allows the Minister to make orders relating to road closures and exemptions for events, subject to certain conditions and compliance with the requirements of the Act and Regulations.
Regulation 7(1) and (2) of the Road Traffic (Miscellaneous) Regulations 2014 require any order made by the Minister to be advertised.
Amendments to the Regulations in 2022 inserted the option of using a website and/or social media service determined by the Minister to advertise declared events that impact on traffic management of the road on which the event is being held or surrounding roads.
These options were included to provide greater flexibility and more cost-effective options than the previous choices of a ‘newspaper circulating generally in the state’ or the ‘government gazette’.
The Minister for Infrastructure and Transport has recently issued a Notice of Determination which specifies the websites and social media services that may be used for advertising events as required by section 33 of the Road Traffic Act and Regulation 7 of the Road Traffic (Miscellaneous) Regulations.
