Last chance to provide feedback on the draft Local Nuisance and Litter Control Amendment Bill and Regulations

11 January 2023
Consultation is now open for councils to give feedback to the LGA on the proposed changes to the Local Nuisance and Litter Control legislation.

Councils are invited to provide feedback to the LGA on the draft Local Nuisance and Litter Control Amendment Bill and Regulations.

The Local Nuisance and Litter Control Act 2016 (LNLC Act) came into effect (in its entirety) on 1 July 2017.

The implementation of the LNLC Act significantly expanded the role of local government in responding to nuisance issues in the community.

Proposed changes to the LNLC Act and Regulations

Through consultation with councils and the community, the EPA has developed various proposed changes to the LNLC Act and Regulations. The main proposed changes are:

Draft Bill

  • General amendments are proposed to streamline several existing provisions of the Act.
  • Greater clarification on how abandoned trolleys can be managed using the Act.
  • Differential expiations for several offences and new offence provisions
  • General Duty for business owners to minimise litter.
  • Further clarification the Act does not apply to nuisance associated with the service of alcohol.

Draft Variation Regulations

  • Inclusion of light as an agent of local nuisance.
  • Further clarification on what is not local nuisance.
