Learn about changes to Local Nuisance and Litter Control Act

1 March 2024
In February, the Local Nuisance and Litter Control (Miscellaneous) Amendment Bill 2024 was introduced into Parliament.

This Bill implements the amendments developed during the review of the Local Nuisance and Litter Control Act 2016 (“LNLC Act”), following an extensive consultation process.

The LGA has worked closely with councils and the EPA, advocating to improve the mechanisms within the Act to enable councils to better manage and respond to nuisance and litter issues in their communities.

What changes are outlined in the Bill?

The amendment Bill features reforms across numerous aspects of the LNLC Act.

These include:

  • improved cost recovery mechanisms for local government
  • provisions to improve the management and collection of abandoned shopping trolleys
  • increased expiation fees to improve deterrence
  • more efficient processes for the assessment and issuing of exemptions
  • the inclusion of an offence to install an air conditioner or a light in a place where it causes local nuisance
  • the addition of a general duty for business owners to prevent or minimise litter resulting from their business, including from stormwater management systems
  • improved delineation of responsibility between councils and the Liquor and Gambling Commissioner for the regulation of different types of nuisance occurring on premises licensed under the Liquor Licensing Act 1997.

What input has local government had into these changes?

Since the review commenced in 2019, the LGA has undertaken significant consultation with councils and provided opportunities to give input into the review through:

  • attendance at information sessions and forums
  • participation in the local government LNLC Act review working group
  • written feedback and comments to inform LGA submissions to the Environment Protection Authority (EPA).
