Calls for changes to draft defibrillator regulations

24 January 2025
LGA South Australia has made a submission on behalf of members responding to new draft defibrillator regulations and the financial impact they may have on councils and communities.

The state government recently concluded consultation on the Automated External Defibrillators (Public Access) Regulations 2024. Our written feedback has been informed through member consultation.

While LGA supports the intent of the legislation to save lives, we are concerned the broad scope of the Automated External Defibrillator Bill 2022 – originally introduced by the Hon Frank Pangallo – could impose tens of millions of additional dollars in additional costs on councils and communities.

This comes at a time when financial sustainability remains the number one challenge for local government, compounded by cost-of-living pressures.

Councils may be forced to cut services or increase rates to meet new defibrillator obligations – both of which are poor outcomes for communities.

Our recommendations

In our latest submission, LGA has recommended:

  • clearly defining what constitutes a facility to narrow the broad interpretation
  • excluding war memorials, religious buildings, public art, historical markers, signage, audio visual equipment, temporary structures and disused buildings as facilities
  • providing statutory immunity to councils for any breaches of the defibrillator legislation.

Further details of these recommendations are outlined in our full Automated External Defibrillators (Public Access) Regulations 2024 submission. (PDF 2.7 MB)

LGA previously raised concerns in a submission on the proposed regulations in May 2023, and while some defects in the original AED Act have been addressed, critical issues remain unresolved.

Next steps and information for councils

LGA has urged the state government to enact the revised regulations before the AED Act begins applying to councils on 1 January 2026.

To assist councils in navigating these changes, we are preparing a webinar on defibrillator-related issues, to be held in the coming weeks. Registration information will be provided soon.

Councils are encouraged to:

  • review the LGA’s submission for detailed insights
  • participate in the upcoming webinar
  • connect with LGA for further guidance and support.
