Panel Contracts

LGA Procurement has established contracts for the supply of a wide range of goods and services.

When a council chooses to use an LGA Procurement contract it removes the necessity to approach the wider market. This is because LGA Procurement has already undertaken a rigorous open tender process that satisfies probity requirements (with particular reference to the Local Government and ICAC Acts) and achieves best value for councils.

Suppliers appointed to each panel have been evaluated and have agreed to contractual terms and conditions that meet the needs of local government (some of which may be outside of industry-standard trading terms).

LGA Procurement also partners with its interstate counterparts as part of the National Procurement Network to achieve benefits far beyond the reach of an individual council or region.

Strategic Alliances 

The following wording incorporated into Councils Procurement Policy (Strategic Alliances) results in the use of VendorPanel as a legally acceptable method of procurement and negates the requirement to undertake an Open Tender Process.

If the Council enters into a strategic alliances procurement process under their Procurement Policy (Strategic Alliances) then there will be no requirement for the Council to approach the wider market or enter into a separate RFT/RFQ as an open tender process has already been undertaken. Council can meet its procurement requirements through contractual arrangements established and administered by other organisations that demonstrate adherence to the requirements of this policy. The use by the Council of Strategic Alliances means that the methods of procurement set out in the Procurement Policy will be undertaken pursuant to and in accordance with the arrangements set out under the Strategic Alliances.

Insurances

Councils should note that LGA Procurement panel suppliers update their own insurances on a cyclic basis.  LGA Procurement will expedite any outstanding information, but regardless, insurance policies can be cancelled or lapsed at any time and Councils should always seek confirmation directly from Suppliers wherever contract risk is high.

What happens if a Panel is due to expire and I have an agreement that expires after this date?

The Heads of Agreement with all panel suppliers outlines the following terms:

“Notwithstanding the expiry or termination of this Agreement, the terms of this Agreement will continue to apply to all Customer Contacts and related Orders entered into during the Term which remain ongoing past the expiry or termination of this Agreement until such time as the relevant Customer Contract and related Order is terminated or expires.”
